Notice - Title to all wine purchases passes immediately to the purchaser at our premises in Rancho Santa Margarita, California at the time of purchase. We make no representation to the legal rights of anyone to ship or import any wines into any state outside of California. The buyer is solely responsible for shipment of wines. By placing an order, you authorize us to act on your behalf to engage a common carrier to deliver your order to you. Alcoholic beverages may be sold and delivered only to persons who are at least 21 years old. In placing your order, you represent to us that you are at least 21 years old and the person to whom delivery will be made is at least 21 years old. When your wine is delivered, ID will be required.

Terms and Conditions - All wine is sold “AS-IS,” without any representations or warranties, express or implied, including, but not limited to, as to merchantability, fitness for a particular purpose or other description of physical condition. "Old" wines, or those purchased from private collections are NOT guaranteed for drinkability.

Shipping Addresses - A street address is required for all shipments. We can not ship to: P.O. Boxes, APO addresses, Hospitals, Military Bases, Colleges, Cruise Ships and Hotels.

Shipping Limitations – Under current, and constantly changing laws, we may not be able to ship to certain states and for certain, we do not ship to the following states: Alabama, Arkansas, Delaware, Kentucky, Maine, Maryland, Massachusetts, Mississippi, Montana, New Hampshire, New Jersey, Oklahoma, Pennsylvania, Rhode Island, South Dakota, Tennessee, Texas and Utah. Items such as accessories and glassware may be shipped to all 50 states.

Errors and Omissions - We are not responsible for typographical errors of any kind. There may be errors/omissions in listed prices, quantities, vintages and label or bottle images. We reserve the right to adjust listed prices at our discretion, without prior notice. The listing of a price for any wine on this Web site is not an offer to sell that wine, but rather is a solicitation for an offer from you, the consumer, to purchase that particular wine. A contract regarding that particular wine is not formed until Amazing Grapes Wine Store accepts your offer to purchase same.

Shipping Rates and Methods - Exact shipping rates for your entire order will be shown to you in the shopping cart prior to checkout. Certain states have restrictions on the quantity of bottles that can be ordered. We strictly adhere to the state liquor authority laws. We will notify you via email if your order cannot be fulfilled due to a restriction.
Most orders are processed the same day as the online entry of your order if placed before 3pm. We can usually ship your order within 1 to 3 business days. Depending on your location, the shipment will then take an additional 1-5 days in transit. If for any reason there are delays longer than this, we will notify you immediately via email.
We ship via the following methods to all locations, except HI and AK, which are 2 day air only:

• Ground
• 2 day air
• 3 day air
• Overnight

HI & AK customers are excluded from any free shipping offers and promotions.

Shorted, Incorrect or Damaged Products - All claims for shorted, incorrect or damaged product must be made within 30 days of receipt of delivery. Returns due to any other reason will be at the purchaser's expense and are subject to a 25% restocking fee.

Storage - If you are aware of an extreme hot or cold spell in your area, please notify us if you wish to delay shipment until the weather is more favorable. If your area is experiencing extreme weather conditions, Amazing Grapes Wine Store can briefly hold your order for future shipment up - to 30 days maximum. We are a high volume wine retail store; not a wine storage facility - our warehouse space is very limited. Orders that exceed the 30 day holding period are subject to a storage fee assessed solely at our discretion, and our liability in such cases is limited to the original transaction price.

General - This Agreement shall be governed in all respects by the laws of the State of California, County of Orange. We do not guarantee continuous, uninterrupted or secure access to our services, and operation of our site may be interfered with by numerous factors outside of our control. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. You agree that this Agreement and all incorporated agreements may be automatically assigned by Amazing Grapes Wine Store, in our sole discretion, to a third party in the event of a merger or acquisition. This Agreement sets forth the entire understanding and agreement between us with respect to the subject matter hereof.
